Short Description:
The premature closing of a law office can result from the unexpected disability, death, disappearance, or discipline of a lawyer. The failure to plan adequately for the unexpected can result in harm to clients and in confusion and hardship for the lawyer’s family, staff and professional colleagues. Developing a succession plan in advance ensures the orderly transfer of a client’s affairs and file to a new lawyer, as well as the return of moneys held in trust, and satisfies the lawyer’s ethical obligation to provide competent and diligent representation.

This session will discuss the SECURE Act, passed in December, 2019. What we know and what we still need guidance on. It will also discuss the CARES Act and subsequent guidance on dealing with the economic fallout of the pandemic. Allison DeSantis
Short Description:
Ms. DeSantis will discuss the specifics of the Ohio Notary Modernization Act and its implications on Ohio notaries. Senate Bill 263: The Ohio Notary Modernization Act overhauled Ohio’s notary laws by centralizing the application process to ensure consistent standards across the state. Under the new law, the Ohio Secretary of State’s office will process and manage the notary application and renewal process in Ohio, as well as investigations and discipline. Additionally, the law places a stronger emphasis on educating notaries throughout their tenure to ensure that all notaries remain aware of their obligations. Finally, recognizing that transactions are moving off paper and to a digital format, the new law creates the ground work for permitting electronic and online notarial acts. As the way we do business has changed in 2020, the need for remote online notarization is even greater. This presentation will cover best practices for electronic and online notarizations during a time of social distancing.

In the modern workplace, artificial intelligence tools are used throughout the employee life-cycle, i.e., recruitment to termination. In theory, employers rely on AI tools to promote efficiency and predictability in outcomes. A well-trained tool could actually help to mitigate human biases. In reality, however, if data systems used to train the machines harbor implicit or explicit human bias, the AI tool will inherit the biased decision making. This course explains how AI tools are “trained” and the potential legal implications of AI in employment decision-making.
